Terms of Service

These Terms of Service ("Terms") govern access to and use of Aivrae, including aivrae.com, the Aivrae console, API gateway, API keys, prepaid credits, model-routing features, and related services (collectively, the "Service").
1. Service and contact
The Service is provided under the Aivrae name ("Aivrae," "we," "us," or "our").

2. Acceptance and eligibility
By creating an account, purchasing credits, using an API key, or otherwise using the Service, you agree to these Terms, the Privacy Policy, the Refund Policy, and the Acceptable Use Policy.
You must be at least 18 years old and legally capable of entering into a binding agreement. If you use the Service for an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
If you do not agree to these Terms, do not use the Service.
3. The Service
Aivrae provides an independently operated AI API gateway. The Service allows users to create and manage API keys, route compatible API requests to selected third-party AI model providers, monitor usage, and pay for eligible usage with prepaid credits.
Aivrae is not the creator of third-party foundation models unless expressly stated. Model names are used to identify compatible integrations. Aivrae is not affiliated with, sponsored by, or endorsed by OpenAI, Anthropic, Google, or any other model provider merely because its models or compatible interfaces are available through the Service.
Third-party providers may change, restrict, suspend, or discontinue models and features. Their availability, output, safety controls, data handling, and usage rules may affect the Service. You must also comply with any provider terms that apply to your selected model or feature.
4. Accounts and API keys
You must provide accurate account information and keep it current. You are responsible for all activity performed through your account and API keys, including activity by employees, contractors, applications, or other persons to whom you provide access.
You must:
- keep passwords, sessions, and API keys confidential;
- use appropriate access controls and rotate exposed credentials promptly;
- notify us at [email protected] if you suspect unauthorized access; and
- ensure that your applications and end users comply with these Terms.
You may not sell, publish, share, or transfer account credentials or API keys except to authorized personnel acting for the same account owner.
5. Pricing, usage, and prepaid credits
5.1 Pricing
Current model usage rates are displayed on the public pricing page and in the Service. Rates may depend on the model, request type, token volume, media duration or resolution, cache usage, routing group, and other metered features.
We may change rates prospectively. The rate and metering rules in effect when a request is accepted apply to that request. A checkout page may display a separate payment amount, currency, tax amount, or provider fee before you authorize a credit purchase.
5.2 Credit delivery and use
Prepaid credits are added only after payment is confirmed by the applicable payment provider. Credits are deducted when eligible API requests or tasks are processed. Usage records maintained by Aivrae are the authoritative record of credit consumption, subject to correction of verified billing errors.
Credits:
- do not have a scheduled expiration while the account remains active and the Service continues to be offered;
- are not legal tender, electronic money, a deposit, or stored monetary value outside Aivrae;
- cannot be redeemed for cash;
- cannot be sold or transferred to another person; and
- may be used only for eligible Aivrae services.
Promotional or complimentary credits may be subject to separate conditions disclosed when granted.
5.3 Account closure and credit transfers
Before closing an account, you may contact [email protected] to request transfer of unused credits to another Aivrae account that you own. A transfer is not automatic and may be refused or delayed for identity, ownership, fraud, sanctions, payment-dispute, or security checks.
If a permitted transfer or refund is not completed before account closure, remaining credits are forfeited, except where applicable law requires another result. Credits associated with fraud, chargebacks, policy violations, or unauthorized payments may be frozen or removed while the matter is investigated.
6. Payments, taxes, and Merchant of Record providers
The payment provider applicable to a purchase is disclosed at checkout. Depending on the selected payment method:
- Creem or Waffo Pancake may act as Merchant of Record and legal seller for its respective payment transaction; or
- another disclosed provider may process the payment on behalf of Aivrae or an applicable seller.
The provider's buyer terms, privacy notice, tax treatment, supported payment methods, and refund procedures may also apply to that transaction. If provider terms conflict with these Terms solely on payment processing, tax, card-network, or refund execution, the provider terms control that part of the payment transaction. These Terms continue to govern use of the Aivrae Service and credits.
You authorize the disclosed provider to charge the amount shown at checkout. Applicable taxes, currency conversion, issuer fees, or bank fees may affect the final amount. Aivrae does not receive or store your full card number or card security code.
7. Refunds and payment disputes
Refund eligibility is described in the Refund Policy. In summary, a purchase of completely unused credits may be eligible for refund if requested within seven calendar days after purchase. Consumed credits are generally non-refundable. Duplicate charges, failed credit delivery, and verified billing errors may also qualify.
Mandatory consumer rights remain unaffected. A Merchant of Record or payment provider may process a refund, reversal, or chargeback as required by law, card-network rules, fraud controls, or its own buyer terms.
Contact [email protected] before initiating a payment dispute so that we can investigate. Fraudulent or abusive disputes may result in temporary account restrictions while the transaction is reviewed.
8. Acceptable use and AI safety
You must comply with the Acceptable Use Policy. Prohibited uses include illegal activity, fraud, malware, credential theft, pornography or NSFW generation, child-unsafe content, unlawful violence or hate content, deceptive deepfakes or impersonation, intellectual-property infringement, and attempts to bypass model or platform safety controls.
For image and video generation, Aivrae and selected upstream providers may screen prompts, inputs, and outputs using automated systems and human review. Requests or outputs may be blocked, delayed, removed, or reported when necessary to enforce safety rules or applicable law. Moderation is not perfect and does not transfer responsibility for your use of the Service to Aivrae.
9. Inputs, outputs, and intellectual property
You retain the rights you hold in prompts, files, instructions, and other content submitted to the Service ("Inputs"). You grant Aivrae a limited, non-exclusive license to host, transmit, transform, moderate, and otherwise process Inputs only as reasonably necessary to operate, secure, support, and improve the Service, comply with law, and enforce these Terms.
As between you and Aivrae, Aivrae does not claim ownership of model outputs generated for you ("Outputs"). However, whether an Output is protectable or owned by any person depends on applicable law and the terms of the selected third-party model provider. Outputs may be similar or identical to content generated for others and may not be unique.
You must have the rights and permissions needed to submit Inputs and use Outputs. You are responsible for reviewing Outputs for accuracy, legality, safety, and third-party rights before relying on or distributing them.
Aivrae does not use API Inputs or Outputs to train its own general-purpose foundation models. Third-party model providers process Inputs and Outputs under their own terms, privacy notices, account settings, and retention practices.
The Aivrae name, branding, website, software, documentation, and original content remain owned by Aivrae or its licensors. These Terms do not grant you rights to use Aivrae trademarks except to identify the Service accurately.
10. Privacy and data security
Our processing of personal information is described in the Privacy Policy. API traffic may be transmitted to third-party model providers selected through the Service. Do not submit personal information, confidential material, or regulated data unless you have a lawful basis and the selected provider and Service configuration are appropriate for that data.
We use reasonable technical and organizational safeguards, but no online service can guarantee absolute security. You are responsible for securing your own applications, devices, networks, credentials, and data.
11. Service availability and changes
The Service is provided on an "as is" and "as available" basis. Maintenance, network conditions, upstream provider incidents, policy changes, capacity limits, sanctions, legal requirements, or security events may affect availability.
We may add, remove, replace, reroute, rate-limit, or discontinue models, endpoints, payment methods, or features. Where reasonably practicable, we will provide notice of material changes that adversely affect paid users, but urgent security, legal, or provider changes may take effect immediately.
12. Suspension and termination
We may restrict, suspend, or terminate an account or API key when reasonably necessary to:
- address a breach of these Terms or the Acceptable Use Policy;
- prevent fraud, abuse, security incidents, or harm;
- investigate payment disputes or unauthorized transactions;
- comply with law, sanctions, court orders, or provider requirements; or
- protect Aivrae, users, payment providers, model providers, or third parties.
You may stop using the Service and delete your account through the available account controls. Before deletion, review Section 5.3 regarding unused credits. Provisions that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, liability limits, dispute terms, and record retention, remain effective.
13. Disclaimers
To the maximum extent permitted by law, Aivrae disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy of AI Outputs.
AI Outputs may be inaccurate, incomplete, biased, offensive, outdated, or unsuitable for a particular purpose. They are not a substitute for qualified legal, medical, financial, safety, or other professional advice. You are responsible for human review and for decisions made using Outputs.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
14. Limitation of liability
To the maximum extent permitted by law, Aivrae is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, or opportunities arising from the Service, upstream providers, Outputs, or unauthorized account access.
To the maximum extent permitted by law, Aivrae's total aggregate liability arising from the Service will not exceed the amount you paid for the Service during the 12 months immediately before the event giving rise to the claim.
These limits do not apply to liability that cannot be limited under applicable law, including liability for intentional misconduct, fraud, or personal injury where exclusion is prohibited. Mandatory consumer protections remain unaffected.
15. Indemnity
To the extent permitted by law, you agree to compensate Aivrae for third-party claims, losses, and reasonable costs arising from your unlawful Inputs, misuse of Outputs, violation of third-party rights, breach of these Terms, or use of the Service by persons acting through your account. This section does not apply to the extent a claim was caused by Aivrae's own unlawful conduct.
16. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-laws principles.
Before filing a claim, you and Aivrae will attempt in good faith to resolve the dispute by contacting [email protected] and allowing at least 30 days for a response, unless urgent relief is reasonably required.
Subject to mandatory law, disputes that cannot be resolved informally shall be submitted to a competent court with jurisdiction in the People's Republic of China. If consumer law in your place of residence gives you a mandatory right to bring a claim in another court or under another governing law, that mandatory right is preserved.
17. Changes to these Terms
We may update these Terms to reflect changes in the Service, providers, law, security practices, or business operations. The updated version will show a new effective date. We will provide reasonable notice of material changes through the website, account interface, or email where required. Continued use after the effective date constitutes acceptance to the extent permitted by law.

These Terms are published in English. If a convenience translation is provided, the English version controls to the extent permitted by law.
